Regulamine

I.Conditions of Purchase:
I. 1. The condition of purchase is the agreement and acceptance of these terms and conditions.

I. 2. Purchases can be made by natural persons (in connection with their business activity or as consumers, i.e. natural persons making a purchase for private purposes, i.e. not directly related to their business or professional activity - hereinafter interchangeably referred to as natural persons or consumers) and institutions, organisations, public entities and legal persons.

I. 3. sales to natural persons, companies are envisaged on the basis of prepayment based on a pro forma invoice.

I. 4. in the case of individuals and companies, the order is handed over for fulfilment after payment has been recorded and the designs have been approved.

I. 5. in the case of public bodies, organisations, institutions and legal entities, it is permissible to allow payment within a deferred payment period on the basis of an individual agreement between the parties. SpiroPrint is entitled to refuse deferred payment without justification.

I. 6 Once the design has been accepted and payment has been made, the customer cannot withdraw from the transaction.

I. 7. The legal basis for issuing and sending invoices in electronic form shall be art. 106 of the Act on Value Added Tax of 11 March 2004 (Journal of Laws No. 54, item. 535) An invoice sent electronically in accordance with the Act is equivalent to sending an invoice issued on paper and constitutes an accounting document.

I.8. The owner - hereinafter referred to as the seller - of the online shop www.spiroprint.pl is: SpiroPrint spółka jawna, with its registered office in Żary at ul. Słowackiego 4J with NIP number: 924-190-08-27, REGON: 081006270 and KRS: 404991.

II. Conditions of performance:

II. 1. an order is realised within 3 to 14 working days from the moment of booking the payment made on the basis of a pro forma invoice and approval of the designs, in the case of individuals and companies. Payments for the service shall be made to the SpiroPrint Company's bank account held with Bank Santander S.A. Branch in Żary with registered office in Żary.

II. In case of public units, organisations, institutions and legal persons, the order is carried out within 3 to 14 working days from the moment of approval of the designs.

III. Complaints:

Complaints on goods

III. (1) A complaint may be lodged by any customer whose order has not been carried out in accordance with the order or who has received defective goods.

III. (2) Complaints should be submitted by e-mail to: reklamacje@taniegadzety.pl

III. (3) Complaints shall be processed within 7 working days from the day following the day of their receipt (if the day following the day of receipt of the complaint is a day off work (Saturday, Sunday, holiday), the deadline for processing the complaint will be counted from the first working day following the day on which the complaint was submitted).

III. Each complaint should contain a detailed description of the discrepancy.

III. (5) Each complaint submitted by the customer and meeting the above conditions will be considered individually.

III. (6) Individuals who have ordered goods in connection with their business activity, public entities, organisations, institutions and legal persons are obliged to check the conformity of the goods with the order in terms of quality and quantity within 7 days of receipt of the goods. The day on which the goods are collected shall be deemed to be the day on which they are delivered by a courier/other postal operator chosen by the parties to the registered office of the party ordering the goods indicated in the order. A complaint lodged after the expiry of the 7-day period counted from the date of receipt of the goods will not be taken into consideration.

III. In order for a complaint to be taken into account, the entire consignment of the goods complained of must be retained for verification purposes.

III. 8. SpiroPrint is liable under the quality guarantee. SpiroPrint is not liable under warranty.

IV. Deadline for the submission of complaints by natural persons purchasing goods for purposes not directly related to their business or professional activity (consumers within the meaning of Article 22 1 of the Act of 23 April 1964 Civil Code).

IV. 1. Consumers are obliged to check the conformity of the goods with the order in terms of their quality and quantity within 7 days from the date of receipt of goods. The day of receipt of goods shall be the day of their delivery by courier/other postal operator selected by the parties to the registered office of the party ordering the goods indicated in the order. Any complaint submitted after the expiry of the 7-day period counted from the date of receipt of the goods will not be taken into consideration.

IV. 2. Notification of complaints shall be accepted on working days until 16:00.

IV. (3) Complaints will be considered within 7 working days from the day following the day of their receipt. If the day following the day of complaint receipt is a holiday (Saturday, Sunday, public holiday), the complaints shall be considered on the first working day following the day of complaint.

V. Right of withdrawal by an individual purchasing an item/service for private purposes not related to his/her business activity (consumer).

V. 1 The conclusion of the contract is reached by the acceptance of the design or the payment of the proforma invoice, whichever comes first If the consumer's first action is to accept the design, he is deemed to have concluded the contract with SpiroPrint at the moment of acceptance. If the consumer's first action is to pay the proforma invoice, then the date of this action is deemed to be the date of the conclusion of the agreement.

V. (2) The consumer agrees that confirmation of the conclusion of the contract will be sent to him by sending information to the e-mail address from which the consumer supplied the print material.

V. 3. A consumer who has concluded a distance or off-premises contract may withdraw from the contract within 14 days without giving any reason and without incurring costs, with the following exceptions as regards incurring costs:if the consumer has chosen a method of delivery other than the cheapest usual method of delivery offered by Spiroprint, Spiroprint shall not be obliged to reimburse the consumer for any additional costs incurred by the consumer,The consumer shall only bear the direct costs of returning the goods unless Spiroprint has agreed to bear them or has failed to inform the consumer of the need to bear these costs.

V. 4 The right of withdrawal from an off-premises or distance contract does not apply to contracts:

1) for the provision of services where the trader has performed the service in full with the express consent of the consumer, who has been informed before the performance starts that he will lose his right of withdrawal after the trader has performed the service;

2) where the subject of the performance is a non-refabricated item produced to the consumer's specification or intended to meet the consumer's personalised needs. By the specification of the consumer is meant the production of the thing in accordance with the design of the consumer, including prepared at his choice graphics, content, colours, other individually prepared for this consumer product characteristics).

V. 5 The consumer may withdraw from the contract by submitting a statement with the content as in the template attached in PDF format to the Terms and Conditions. Sending the statement before the deadline is sufficient to meet the deadline.

VII.Return of goods.
VII. (1) Once the withdrawal from the contract has been submitted, the Consumer is obliged to send the goods to SpiroPrint immediately, within a period not exceeding 14 days counted from the date of withdrawal from the contract.

VII. 2. The costs of returning the goods shall be borne by the Consumer (Art. 34, Paragraph 2 of the Consumer Rights Act).

VII. 3. SpiroPrint shall reimburse the payments made by the Consumer, within 14 days from the date of receipt of the declaration of withdrawal from the contract and the proof of return of the goods to SpiroPrint.

VII. 4. SpiroPrint shall refund the payment using the same method of payment used by the consumer, unless the consumer has expressly agreed to a different method of refund that does not incur any costs for the consumer.

VIII.Complaints on damaged mail:
VIII. 1 The condition for such a complaint is that the goods are visibly damaged or partially lost.

VIII. 2. a claim must be noted on the transport document immediately upon receipt of the goods and a damage report must be drawn up in the presence of the carrier. Claims must be made in writing within 5 days of receipt of the consignment. If the consignment is damaged, the consignee is obliged to leave the consignment at SpiroPrint's disposal until the claim procedure has been completed.

VIII. (3) A complaint lodged after the expiry of 5 days from the date of acceptance of the consignment without reservations shall result in the lapse of claims.

IX. Complaint about the delivery time:

IX. (1) The consignee of a consignment who has received the consignment after the agreed date must indicate this fact on the consignment note in the presence of a courier company representative. It is required to state the date and time of delivery and the reason for delay (given by a representative of the courier company). In case of the documented refusal of the consignment by the Recipient, the consignment is returned to the SpiroPrint head office at the Recipient's expense.

IX. Complaints regarding non-performance or undue performance of the contract for the provision of Services and Additional Services may be submitted to courier companies only by Tanie.Dlugopisy.pl. Complaints should be submitted in writing within 7 days.


X. Printing materials:

X. (1) SpiroPrint is not responsible for the content of the works sent by the customer. If the materials contain illegal content, we may refuse to print such materials.

X. 2. the materials sent by the customer for a given order must technically correspond to the parameters and specifications indicated on the website: taniedlugopisy.pl in the tab: REALIZE ORDER / PROJECT INFORMATION.

X. 3 The Customer confirms that he/she has familiarised himself/herself with the technical requirements referred to in par. X.2. and declares that the materials submitted by him meet these requirements.

X. (4) SpiroPrint may, at its discretion, accept for execution materials sent by the customer which do not meet the technical requirements referred to in para. X.2. and adapt these materials to these requirements, or call upon the customer to send materials which comply with the requirements referred to in Section X.2. X.2. If SpiroPrint itself adjusts the submitted materials to the technical requirements referred to in Section X.2. X.2., the content of materials and graphic form may be changed. SpiroPrint will inform the customer of this change before proceeding with the amended materials. The customer is obliged to check the submitted design with respect to its content (including grammar and spelling) and graphic form. SpiroPrint will only process an accepted order.

X. Should the customer have any problem with the verification of the design in terms of its content or graphic form, he is obliged to inform SpiroPrint of this fact. Acceptance of the design results in its being forwarded for execution. Once the customer's acceptance has been received, SpiroPrint is not responsible for any inconsistencies in the design in terms of content (including grammatical and spelling errors) as well as graphic form.

X. 6 The order completion date is extended by the time during which SpiroPrint adjusts the customer's material to the technical requirements referred to in pt. X. 2.

X. 7. SpiroPrint does not archive image files. Files on the FTP server and uploaded to orders after 30 days are deleted.

XI. SpiroPrint is not responsible for:

(a) Printing works incorrectly prepared in terms of content;

b) Printing of works accepted by the customer and containing technical, quantitative, colour - goods and printing errors;

c) Delays in the delivery of materials by external couriers;

d) Delays in printing that have arisen as a result of external factors beyond the control of TanieDłgopisy.pl, power cuts, delays in the delivery of materials intended for printing, etc.; e) Delays in the deadline for the completion of the work to be carried out by the customer; f) Delays in the delivery of materials intended for printing;

e) Delays in the completion date resulting from the deadline for supplying correct data by the customer;

f) For the timely transfer of funds between the customer's bank and our bank;

g) The quantity, delivered to the customer and ordered by the customer, of the product, provided that it is within +-3% of the quantity ordered at purchase.

h) SpiroPrint is not responsible for the timeliness of courier shipments. Complaints concerning the quality of courier shipments will be considered only upon presentation of the damage documents (see point III).

XII. SpiroPrint Company reserves the right to change the regulations, information about the change will be placed on the main page.

XIII. Any and all disputes arising from the agreement concluded by the parties, including in connection with improper performance, non-performance of the agreement, as well as with respect to damages shall be recognised by the Court having jurisdiction over the registered office of SpiroPrint.In the case of litigation with a consumer, the local jurisdiction of the court shall be applicable.

INFORMATION CLAUSE

In accordance with Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016. on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU. L. 2016, No. 119) - hereinafter RODO - I inform you that:

  1. The administrator of your personal data is SpiroPrint E. Zalewska, A.Burzyński , Spółka Jawna, NIP: 924-190-08-27, REGON: 081006270, ul. Słowackiego 4J, 68-200 Żary
  2. Your personal data will be processed for the purpose of processing your order - on the basis of Article 6(1)(b) of the General Data Protection Regulation of 27 April 2016, based on your voluntary consent;
  3. You may withdraw the consent you have given at any time, whereby the withdrawal of consent shall not affect the lawfulness of the processing carried out on the basis of consent before its withdrawal;
  4. The provision of all personal data is voluntary, however:
    1. the provision of data such as name, e-mail address and telephone number is necessary for the preparation and transmission of a commercial offer, the sending of an e-invoice, the execution of the terms and conditions of the contract.
    2. The provision of personal data is voluntary; however, the refusal to provide data may result in the refusal to process the order.
  5. In connection with the processing of data for the purpose indicated in para. 3, your personal data may be made available to other recipients or categories of recipients of personal data:
    1. entities authorised to receive your personal data on the basis of the relevant legislation;
    2. entities which process your personal data on behalf of the Data Controller on the basis of an agreement concluded with the Data Controller for the entrustment of personal data processing (so-called Processors), e.g. insurance companies and banks.
  6. Your personal data will be stored for a period of:
    1. one year from the date of your consent to the processing of your personal data, which was collected for commercial purposes, while the immediate conclusion of a contract did not take place, i.e. processed for the purpose of a possible presentation of an offer.
    2. SpiroPrint E. Zalewska, A.Burzynski , Spółka Jawna like the Administrator may store personal data for as long as the legitimate interest allows, which is not more important than the person's right to privacy. Even if SpiroPrint E. Zalewska, A.Burzynski , Spółka Jawna has no need to retain personal data, their storage may be required by law (e.g. commercial or tax law). In such cases, the data may only be used to comply with the legal requirements and may not be otherwise accessed.
  7. Your personal data will not be transferred outside the European Economic Area/international organisation.
  8. Your personal data will not be used for automated decision-making, including profiling.
  9. You have the right of access to the content of your data and the right to rectification, erasure, restriction of processing, the right to data portability, the right to object, the right to withdraw your consent to processing at any time without affecting the lawfulness of the processing performed on the basis of the consent given before its withdrawal. A declaration of withdrawal of consent to the processing of personal data requires its submission in writing or electronically to rodo@spiroprint.pl.
  10. You have the right to lodge a complaint with the GIODO/President of the Office for Personal Data Protection if you consider that the processing of your personal data is unlawful.
